Update on Dr. Derrick Todd’s Criminal Rape Indictment and Lubin & Meyer’s Ongoing Civil Sexual Assault Lawsuits Against Him

Grand jury hands down criminal indictment of former Brigham and Women's rheumatologist on two counts of rape

Dr. Derrick Todd, the former rheumatologist who practiced at Brigham and Women's Hospital in Boston and Charles River Medical Associates in Framingham, has been formally indicted of two counts of rape, the Middlesex County District Attorney's Office has announced.

How Does the Criminal Case Impact the Civil Case?

Lubin & Meyer attorney Willliam Thompson, who is lead counsel on the class action lawsuit against Todd and his supervisors, provides some context: "What today's news means, is that a grand jury was assembled, was presented with evidence of Dr. Todd’s actions, and has determined there is enough evidence to charge him with a crime."

Todd pled not guilty at his arraignment today. 

"While this is just the beginning of the criminal case against Dr. Todd, it helps to validate the civil claims Lubin & Meyer is pursuing on behalf of hundreds of Dr. Todd’s former patients. Our civil cases — currently in discovery — will run on a parallel track with the criminal case," said Thompson. 

"We will continue to work tirelessly for justice for all of the patients who put their trust in this doctor, and who were so severely let down by this doctor and the people who were supposed to oversee him to ensure this kind of misconduct would never happen."

The class action complaint lists a dozen defendants including Derrick Todd, M.D., Brigham and Women’s Hospital, Brigham and Women’s Faulkner Hospital, Charles River Medical Associates, as well as administrators in supervisory positions at Charles River Medical Associates.

Brief History of the Civil Case

Todd resigned from Brigham and Women's after an investigation by the hospital following complaints brought by two physicians in April of 2023 regarding improper exams by Dr. Todd. Patient complaints soon followed, and Todd agreed to stop practicing medicine in September 2023. On October 11, 2023, Lubin & Meyer filed a class action lawsuit representing more than 60 former patients. On July 1, 2024, Lubin & Meyer filed a new master complaint in Suffolk Superior Court that consolidated all the civil cases against Todd, representing more than 200 former patients.
